So as of yesterday I started having tranny issues... Recap* 2006 Hardtop with automatic transmission. In regular mode my RPM's will jump up as high as 5 while traveling at 25mph, refusing to shift while traveling at 50+mph and climbing a hill my RPM's drop to almost one. I am not having too many issues while in sport mode. I have had this car since March 8th and have put almost 5k miles on him. He also is not wanting to have a prompt start... In my research I'm now disgusted with what I think the issue is... CVT? The kicker... If I had the $6k to fix it I missed the deadline for the lawsuit by 20 days!!! Anybody know if this sounds like the issue and if this could be covered under WA state lemon laws?:mad2:

Maybe someone from the WA group of MINI owners here can help you out. Good luck!

Not sure what year you've got, as an 2006 didn't have a "sport" mode but I thought the CVT where only in the early years???

Any oily puddles in the garage? I'd sure have the fluid level checked and it's about time for an engine oil and filter change anyway.

The MCS came out with a real automatic in '05, but the Cooper models did not get a real automatic until Gen 2, I think.

The sport mode I have refers to while in drive I can gently push lever to the right and then my transmission gauges change to sport and I have the option to manually shift. So here is the kicker... the man just took it for a test drive... I went along... after a 20 mile variable speed drive D.B. didn't replicate what he's been doing to me for past 2 days... Continuing assessments...

Here is the "data" for my vin...

I was fixing to post this edited version but got interrupted so here 'tis in it's entirety except for the oily puddle comment:

Found this on another MA thread:
    2002 through 2006 model year MINI Cooper (R50) (produced June 11, 2001 through Nov. 28, 2006); and
    2005 through 2008 model year MINI Convertible (R52) (produced March 6, 2004 through July 31, 2008).

I'm going to check the only mechanic in my area who services MINI's to see what they charge to have fluids changed... and of course take a looky see. I just dont trust mechanics I dont know...

Here's a resource every MINI person should have in their 'Favorites' MINI folder.
    soopercooperinfo.com
You'll find an independent repair shop directory along with just about everything there is that has ever been done, tried or thought better of concerning MINI ownership.

Has the engine light popped on? Have you scanned for a code?

If it is a CVT and you are only 20 days past the deadline call MINI USA. Plead your case, let them know you didn't know about the case until you started having trouble.

I am precluded from giving details, but my sons Gurman car was part of a class action sute. I was a year past the deadline and the componay stilled helped me.

MINI may still fix your car if it's a CVT problem. It's worth a try. Be polite but firm and it may take talking to some type of manger not just the costermer support agent that answers the phone.
    Good luck

In most states lemon law against the manufacturer on a used car won't win or can't even be filed. Your recourse is back to the seller.

I have a 2006 auto Convertible with the CVT. I had issues last October that sound similar to yours. I read multiple posts on this forum and followed some advice I found. (Thank you all by the way) I had the transmission fluid flushed and had the computer reset. It didn't cost too much and was worth a try. I got lucky and it worked. I was at about 60,000 miles. The advice also recommended to do the flush every 20,000-30,000 miles.

Only light that came on was after attempting to start engine Monday morning, engine didnt fully turn over and the warning light came on. I then restarted and the light has been off since...
Does the mini have a way to access codes in the OBC display?

I would take it to your local dealer and see what they say, if you're going to get any help from MINI USA, it will be thru the dealer. Also, they have the machine and proper fluid to do a flush. Few if any independents do....

Automatics have a speed sensors on them. I had a non MINI do the same thing but it was also coding, after a little research and trouble shooting I did find a bad speed sensor, $20 later verything was good to go. Hopefully it will be something as simple as a flush or sensor.

Soooo.... After a test drive and a day of no shifting issues I jump in DB to head to work and there was no starting him... Luckily I caught my boyfriend before he rounded the corner heading to work... drove my dakota, making him drive the F350... My battery is toast so this got me thinking.... when all this started, poor shifting and loss of power, it was after a failed start leading me to restart D.B... Could this all be related to the battery telling me its toast?
Getting new battery this evening ($170 ouch) after a bit of research into type and size... I read on some other boards people who had loss of power when their batteries failed...

It could be, all kinds of odd things happen to MINI's with dying batteries.

As a matter of fact Malaysia Airlines Flight 370 had a dying MIN's battery in it.:lol:
