Back in March I had my R53 towed and the tow driver used a dolly and cracked my oil pan. I submitted a claim, which they turned down. I resubmitted it for the oil pan only. I would really like to have my car up again. It has been at MAG since March. Any help? If this doesn't go thru I will either sue or have insurance total it.
Wow your car has been sitting at the dealer since March. You could pay for it & have your lawyer chase the guilty party for the money. Better than leaving your MINI sit dead for so long. Good luck to you. As you now know, always use a rollback.
I'd suggest you call John over at Best Motor Werks. He may be less than the dealer wants. Very good shop with nice honest people. My go to place for MINI repairs. Best Motor Werks | BMW & Mini Cooper Repair in Columbus, Ohio.

The oil pan is just cracked from towing right....not sure where totaled comes into this...even if you ran it without oil....that is a $3500 fix depending on the motor dropped in... Sounds like a $1000 fix...oil pan plus labor.... About what the lawyer would want for 2 hours of work...but add a couple months of car storage...ouch... What am I missing here?! Sometimes you gotta fix stuff...and if you are sure you are right, go after than after the fact. To loose use of a car for months and pay $$$ to store a car is crazy IMO. Good to have you vent a bit...but to say hi....bye is kinda puzzling...
Welcome Aboard! A lawyer writing a letter isn't that much depending on the lawyer and it does work. You need to know what the towing company has for their terms. If they say they aren't responsible for any damage up front then your stuck. Maybe Crankshaft was a used pan he can sell you.
Sounds kind of like the 2006 cooper, $9000 inspection thread on NAM..... You need $9000 in repairs asap... But be have this NEW car....
Yup that's what every old MINI owner should do. Buy the "New Original" F56 it's the greatest MINI ever.

I wish I could keep mine forever....but I fear I will be selling it soon due to some changes in my life....I am a realist that in 3 or 4 years I WISH i could buy it back,,,,but finding a good one will be unlikely...:cryin: But gotta get my life back on track.....kinda in Neutral spinning my wheels...and having a car my wife WILL NOT DRIVE just is not working... Maybe the 4th gen MINI or later 3rd gen will be good...I HOPE...oh well....Guess I might be picking up a flavorless appliance of a car...:mad2::mad2:

Unfortunately not everything in life is "somebody else's fault" ...I suspect the towing company is going to get a free pass....check you receipt...bet it says not responsible for damage... Simple fact is you MIGHT have been charged $1000 or MORE in storage expenses while trying to fight it......so you might loose your car cause you will have a storage lien on it you must pay to get it off the dealer lot....:mad2: Sometimes it is just best to pay the piper, and move on...even if it means fixing the car...then driving down the street to sell it.... Reality is...if you cannot afford a $1000 unexpected expense....you cannot afford a car....sometimes living beyond ones means can get very $$$... leaving a car stored at a dealer broken is a sure way to loose it... I feel for you...if you are the same guy that over on NAM had issues a while back, hats off to you for staying with it... but paying $30 a day or $130 week for storage cause you cannot pay a $1000 bill or to get it towed to the house is NUTZ!! Even if you WIN a small claims case and get paid for the oil pan....you must prove you tried to limit damages and expenses...and $$$$ in storage fees might not get covered...
Mr Zippy, where did you read the OP was paying storage fees? My reading comprehension is not the best, but I didn't see storage fees as being part of the problem. :confused5:
