Crappy, crappy day. Weekend started off great with John and Suzie (good people) hooking Katie and I up, but then it all went downhill. Katie got into a low speed fender bender with her Honda, no injuries, other persons fault. Police were nearby, but didn't do anything other than tell everybody to exchange info and then left. Called ins. and filed a claim, they tell us our options
1. let our insurance fix the car minus deductible and they will try to get money from other insurance company.
2. we call and talk to other ins. company to try and get car fixed.
neither of these options is acceptable to me, I pay and pay so I shouldn't have to do anything other than give my ins. the info and then they tell me where to get it fixed. I'm getting madder and madder at them, but my agent is off today so I have to wait until tomorrow to yell at him. If they don't fix this right I'll be looking for new insurance company.

Hey Neil, you shouldn't have to any leg work for repairs to your vehicle. That's why you pay premiums! Many moons ago, I had one of the subcontracted insurance companies, and I was involved in a traffic collision. My agent gave me list of "to do's" in order to get my vehicle properly repaired. Being a younger chap at the time, my pops gave me some stern advice, and in return I called my insurance agent. Needless to say, he took care of everything from then on.
Regarding the officer taking a report, it depends on the agency's policy. For instance, Fresno PD won't take a report unless theres injuries, DUI involved, or city vehicle involved.

Steve, well in looks like all we're waiting on is the Fidanza friction plate. When I placed the order, they said it would take 3-4 weeks for delivery. So, hopefully it comes in this week so I can baby or tow the MINI to the shop next Monday.

If no report is taken, then how do you handle "whos at fault"? With no witnesses it comes down to "he said--she said". Then everybody has to fix their own vehicle, even if not a fault. Correct?
As far as my agent, I don't know if he even knows about the claim. It happened on a holiday weekend and he didn't work on Monday, so I'm giving him some leeway until I talk to him. He should take care of everything or else it is "on like donkey kong":incazzato:

What should take place after both insurance agents are contacted, they'll interview both drivers and any witnesses if possible. Then they'll get together and determine who was at fault. Basically what the officer would have end up doing anyways. Thats why most departments have implemented the policy not to write collision reports unless they meet the criteria I mentioned before. Usually, the officer responds, to a non-injury collision, and runs each driver's license status, and confirm the vehicle's registration and insurance is current.

Thanks very much for the info, this is all new to me so any info is appreciated. What you said makes sense with what is going on, other insurance company called us and got the info and said we should hear something by end of the week.

Sitting back watching this thread its really nice to see the different sides come out. From Law Enforcement to Insurance Rep's along with a whole lot of friends that just care that the victim is taken care of even if she was not driving a real car :incazzato:
