I think Sauber did not appeal because losing the appeal would be potentially much worse than having supposedly broken a rule in the first place.

Following that logic there might be room for a scythe blade tucked under there for a very different sort of 'push-to-pass' function. Hit the 'harvest' button and the blade sweeps out to cut tires on the car ahead...KERS and DRS become harvest-enabling devices... -

This actually turned out to be a suspension failure. Something broke and jammed the wheel. Same part broke on Petrov's car during the same session.
