    I suggest you have a lawyer draw up a letter demanding settlement. Bet they jump up and settle then.

    I am never getting rid of my 05 R53 MINI and all the haters can hate me all they want because I don't give a rats a$$ and I drive a better car in every way. (Especially looks)

    So I got a typed statement from the body shop saying there was no major oil sump damage. I will email it to Agero.

    Wow your car has been sitting at the dealer since March. You could pay for it & have your lawyer chase the guilty party for the money. Better than leaving your MINI sit dead for so long.

    Good luck to you. As you now know, always use a rollback.

    Sounds kind of like the 2006 cooper, $9000 inspection thread on NAM.....
    You need $9000 in repairs asap... But be have this NEW car....

    BE Proud of having a r53!!
    I wish I could keep mine forever....but I fear I will be selling it soon due to some changes in my life....I am a realist that in 3 or 4 years I WISH i could buy it back,,,,but finding a good one will be unlikely...:cryin:
    But gotta get my life back on track.....kinda in Neutral spinning my wheels...and having a car my wife WILL NOT DRIVE just is not working...
    Maybe the 4th gen MINI or later 3rd gen will be good...I HOPE...oh well....Guess I might be picking up a flavorless appliance of a car...:mad2::mad2:

    Show me a dealer/shop that's let's a car sit broken in their lot for free for 2+ months.....
    One more issue....the op refers to his car as "slammed" (other threads/places), so lowered to the max....so I really doubt a towing company will pay for damage to a modded car that was towed...
    Really trying to help him out...many folks don't understand that anytime a car is left beyond a "reasonable" time will get hit with storage fees at 90+% of shops...
    Not sure WHY the car was towed to the dealer/shop in the first place.... But a cracked oil pan suffered in the tow "totaling" a car in borderline crazy....look at the parts cost?! Even with 5 hours labor max...still not a "huge" amount....
    Sometimes folks loose sight of the "big picture"..... They get so concerned about a $1000-1500 loss...they miss the $3500-5500 loss they will be taking by letting the issue fester....lets face it...an insurance company I'd unlikely to write a check cause a car worth $3500-5500 took a $1000-1500 mechanical fault.... If they did...wow...don't wanna go there....
    Part of being friendly is pointing out, get it taken care of asap...then go sue, even sell the car...minimize your losses....but to say totaled over getting a cracked oil pan when getting towed...ouch....

    I'm sure the OP realizes the mistakes he made since they have been pointed out to him a few times here. I don't understand his reasoning either, but tried to help as others have.

    Pretty sure if the OP has the work done at the dealer they'd waive any storage fee real or imagined.

    Thanks. I'm working on it. Just been too busy to be more pissed about it than I am, since school just let out and work. Right now I'm just driving my 190e around.

    Do not JB weld something as important as you oil pan. Do it right the first time and you won't have to do it again.

    One thought...
    The oil pan is just cracked from towing right....not sure where totaled comes into this...even if you ran it without oil....that is a $3500 fix depending on the motor dropped in...
    Sounds like a $1000 fix...oil pan plus labor.... About what the lawyer would want for 2 hours of work...but add a couple months of car storage...ouch...
    What am I missing here?!
    Sometimes you gotta fix stuff...and if you are sure you are right, go after than after the fact. To loose use of a car for months and pay $$$ to store a car is crazy IMO.
    Good to have you vent a bit...but to say hi....bye is kinda puzzling...

    A lawyer writing a letter isn't that much depending on the lawyer and it does work. You need to know what the towing company has for their terms. If they say they aren't responsible for any damage up front then your stuck.

    Maybe Crankshaft was a used pan he can sell you.
