Well, looks like I'm going to court on Friday to fight the ticket. The chick that hit me is now claiming "injury" and has obtained a lawyer. Probably an ambulance chaser. So that ought to be a lot of fun.
Based on the impact damage.... The hit couldn't have been too hard... I'm guessing it didn't even set off her airbag... What's a bent fingernail worth in litigation for pain and suffering? It would be interesting if records were pulled and she was texting at impact...
I was maybe doing 25, give or take a few. No airbags went off and the damage to her car was less than mine. I wouldn't be surprised if she was texting right about the time it happened. I'm pretty sure its just a money grab. And that just made my decision that I was going to court to fight it. I'm sure her ambulance chaser lawyer sent her to some questionable chiropractor that said yeah, you are injured and require lots of treatment, and you are in lots of pain.
Fight the ticket, but let your insurance company fight with the ambulance chasing lawyer. You are correct it is a cash grab.

As for the repairs, Im sending it to Vics since that was MAGs suggestion. If they are good enough for MAG, then they are good enough for me. Just waiting for them to get the parts that were ordered and I'll drop it off. If I have to, Ill get a lawyer to fight the ticket. Dunno where I'll get the money for it, but I'll figure it out I guess. Hopefully I wont need it and common sense will prevail. I'm waiting on a call back from the appraiser to see if I can get a statement from him that the damage is inconsistent with the police report. Any suggestions on anything else I can use in my favor?
Well, the appraise cant put anything in writing for me unless he is subpoenaed or the ins co requests a statement from him I understand that. But I guess if it ends up having to go to trial, then they will get a statement from him. But I hope it doesn't go that far and common sense prevails and the court just drops it on Friday.
Been in the sights of ambulance chasers myself and it's infuriating. Hopefully your insurance company will deal with it. My experience with appraisers is that often they won't commit ahead of time because you never know what you'll find when you start to pull pieces off. Good luck!
I'm sure the ins co will fight their side of it, but I was kinda hoping they would give me a hand with my side since that would help their side of it out quite a bit. I've been assigned a new adjuster, but haven't heard from them yet. Hopefully they will call sometime today and maybe be a little more willing to help out than the appraiser was.
After getting some legal counsel that work for Franklin county, its nice having a good friend in the system, I just paid the ticket as I did not have the time or money to really fight it. The insurance co decided that I was 70% at fault, I disagree, but as far as they are concerned my opinion means dick and I should just STFU and pay my premium, typical ins co really. On the bright side, my car is currently in the shop and getting all fixed up. I should have the old girl back sometime next week, I hope. I got a pretty nice VW Passat as my rental, but there is no comparison and I want my baby back. Long story shot, its my fault always and I always get ****ed in some way or another.
