So when he puts the seat in the forward position to let someone in the back seat and he then moves the seat back to where it would be for driving it only locks in place with the seat back all the way down?
There was a thread on NAM about this kind of thing some time back.......I don't remember exactly how it was resolved, but I think it had to do with forcing the seat back into even a father down position and then letting it back up.-

My R53 went into fully reclined position on me while I was in rush hour traffic on a major highway. It was fun!
The mechanism near the seatbelt was the culprit. The dealer just fiddled with it and got the gears all back into place and it was fine. They didn't even charge me for the work.
