I'd find why it has a new clutch at 40K. Also what packages and otehr options does it have.

He said there was a factory defect, so even though its not under warranty they put a new one on for free.
And I do not know what packages it has on it.
Can you type a list up fast for me to ask this guy? He will be calling in prob a few minutes and this is my first car so I dont know what to ask -
Ask him to send/fax a copy of the window sticker listing all the options on the MINI.
This is usually in the back of the manual package folder.
If he does not have this most MINI purchasers know the options they chose. -
He was very knowledgable on his minis and has aftermarket rims so I figure he might of beat the mini up a bit.

Why don't you check other cars in you area and compare for yourself? -
Most importantly, find out what it has in it! Packages, options, etc.
Also, get the VIN and run a Carfax search on it. If anything major has occurred, it'll show there. -

What year is it?
Get a list of everything that's on it, it will help.
Just because they have aftermarket wheels doesn't mean it's been trashed or even driven hard - unless he said he did!
A lot of people replace the stock runflat tires with new non-runflats, and most get new wheels at the same time.
Some markets are stronger and bring more money than others, too. You can only really compare it to other similarly equipped cars in your area. -
Call your local dealer with the VIN as well. Ask the In Service Date, options as delivered and possibly the service history.
